STRATCO HOWTO TIP SKILL BASED COMPETITION

Specific Terms and Conditions General

A person who enters the Competition will be bound by these terms and conditions as well as the General Terms and Conditions for Stratco Competitions. Please read these terms and conditions as well as the General Terms and Conditions for Stratco Competitions carefully.

To the extent of any inconsistency, these terms and conditions will prevail over the General Terms and Conditions for Stratco Competitions.

Competition Period

The Competition will open at 9.00am (ACST) on the 1st day of the month and close at 5.00pm (ACST) on the 28th day of the month in each of the months of October 2016 to December 2016 (Competition Periods). For example, in respect of the October 2106 Competition Period, entries must be submitted between 9.00am (ACST) on 1 October 2016 and 5.00pm (ACST) on 28 October 2016.

Who can enter

Entry is free and is open to all residents of Australia.

Multiple entries are permitted but only one prize will be awarded per person.

Entries must not contain any images:
• in respect of which a third party holds the Intellectual Property Rights where the Entrant has not obtained all necessary consents to copy, disclose, distribute, incorporate or otherwise use the material for the Competition and to grant to Stratco the licences in respect of that image set out in these terms and conditions

• of another person without that person’s permission (or in the case of a minor, the minor’s parent or legal guardian).

Facebook

Entrants acknowledge that:
• all information, images or other content in respect of the Competition posted on Facebook is collected by Stratco and not by Facebook

• the Competition is in no way sponsored, endorsed or administered by, or associated with, Facebook

• Entrants completely release Facebook in respect of all liability arising from the Competition.

How to enter

To enter the Competition, Entrants must submit a HowTo tip via the Stratco Facebook Page or by posting the HowTo tip on their own Facebook Page and using the hashtag #StratcoHowToTip. A HowTo tip can be any tip related to the outdoors, outdoor living, DIY or home improvement.

Determining Winner

The winners will be the best valid entries as judged by the Stratco Marketing Team, having regard to skill, creativity and originality, on the last Friday of each month at 11am ACST. Stratco reserves the right to select additional entries to be used as replacements in the event that the first chosen entrant as a winner cannot satisfy these Terms and Conditions or take a prize.

The winners will be notified via a private message on Facebook. Prizes will be sent within 8 weeks.

Prize on offer

A $200 Stratco Gift Card (Prize) will be awarded as a Prize to one entry submitted during each Competition Period. The Prize winner will be announced on the first working day of the month in South Australia immediately following the month in which their respective entries are made.
Prizes are subject to availability, not transferable or exchangeable and cannot be taken as cash. Prizes will be sent to the winner’s nominated address, Stratco will take no responsibility for prizes damaged or lost in transit.

If Stratco are unable to contact the winner to claim the prize that winner will forfeit the prize in its entirety and it shall be awarded to the next runner up in the competition. Stratco will not be liable for a winner who cannot be contacted and therefore forfeits their prize and no correspondence will be entered into.

Limitation on Liability

To the fullest extent permitted by law:
Any liability that Stratco may have to an Entrant whether for negligence, breach of contract or otherwise in respect of a Competition is, to the fullest extent permitted by law, limited to conducting the Competition and awarding Prizes in accordance with these terms and conditions and the Specific Terms and Conditions for the Competition.
Stratco will have no liability whatsoever for any loss of profits or any other incidental, consequential or indirect loss or other consequence in connection with the Competition.

Release and Indemnity

Each Entrant releases and indemnifies Stratco from and against any liability arising from: Any breach of these terms and conditions or the Specific Terms and Conditions for the Competition by the Entrant.
Any use or misuse of a Prize by the Entrant.
Any other conduct by the Entrant which entitles Stratco to terminate the participation in the Competition of the Entrant.

Severability

If any part or all of any provision of these terms and conditions becomes or is found to illegal or unenforceable that provision may be severed from these terms and conditions and the remaining provisions of these terms and conditions shall continue in force.

Governing Law

These terms and conditions will be construed according to and governed by the law of South Australia, Australia. The parties submit to the exclusive jurisdiction of the courts in and of South Australia in relation to any dispute arising under these terms and conditions.

Definitions

In these terms and conditions unless the context otherwise requires:

ACST means Australian Central Standard Time

Competition means Stratco HowTo Tip Skill Based Competition.

Entrant means an entrant in a Competition and who is eligible to enter that Competition in accordance with these terms and conditions.

Intellectual Property and Intellectual Property Rights includes property and rights in connection with copyright (including future copyright and rights in the nature of or analogous to copyright), know-how, trade mark, service mark, design, inventions (including patents), semi-conductor or circuit layout rights, trade, business or company names, or other proprietary rights, or any rights to registration of such rights (including all renewals and extensions)

Prize means in respect of a Competition, the prize, award or other benefit to be awarded to the winner of the Competition as set out in the Specific Terms and Conditions for the Competition.

Specific Terms and Conditions means in respect of a Competition, the terms and conditions of entry for that Competition published by Stratco at or about the time of the Competition.

Stratco means Stratco Holdings Pty Ltd ACN 007 893 781 and its related bodies corporate (as defined in the Corporations Act 2001).

Stratco Facebook Page means the Stratco Facebook Site which can be found at the following URL : https://www.facebook.com/stratco/

Stratco HowTo Tip means an original tip relating to the outdoors, outdoor living, DIY or home improvement.
